Promotional dynamics “Sajú se double” - Calle 81
 
La Familia del Mono SAS (hereinafter “ Sajú ” or the “ Organizer ”), invites the public to participate in the dynamic “Sajú goes double” (hereinafter the “ Dynamic ”), which will take place on March 1, 2024, through which you can acquire one (1) or several of the one hundred (100) memberships within the framework of the inauguration of the first Sajú optician in the Tienda del Mono Calle 81 (as will be defined later), in accordance with the following Terms and Conditions:

1. Acceptance of the Terms and Conditions


Participation in the Dynamic implies express and complete knowledge and acceptance of these Terms and Conditions. The person who does not agree with this document, on which the Dynamic will be developed, has the full right not to participate in it. However, participation in the Dynamic demonstrates an unequivocal conduct of complete, total and unconditional acceptance of these. These Terms and Conditions will be understood to be complemented and integrated by the information available on the Sajú Website.

 

2. Definitions

For the purpose of achieving a greater understanding of the information contained herein, the following words should be understood as defined below:
 
  • Beneficiary(s) of Membership(s) or Participant(s) : May be the Membership Holder (as defined below) or any person whom the Membership Holder elects to receive one or more pairs of glasses, according to the purchased plan.
  • Inauguration Day : Refers to the day during which the Dynamics will be in force, that is, March 1, 2024, during the hours of the monkey store on Carrera 9 #81-25 in the city of Bogotá.
  • Membership(s) : Refers to the following plans that can be purchased by the first one hundred (100) people to purchase them in accordance with these Terms and Conditions:
  • Bronze Plan : That is, for a total value of COP$500,000 VAT included, you will be able to claim a total of three (3) pairs of glasses from any of the references provided on the Sajú Website (now or in the future), which must be claimed within the next three (3) years from the Inauguration Date. You will receive one (1) pair of glasses of your choice, for each year, in accordance with the other conditions set forth in this document.
  • Silver Plan : That is, for a total value of COP$1,000,000 VAT included, you will be able to claim a total of six (6) pairs of glasses from any of the references listed on the Sajú Website (now or in the future), the which must be claimed within the next three (3) years from the Inauguration Date. You will receive two (2) pairs of glasses of your choice, for each year, in accordance with the other conditions set forth in this document.
  • Gold Plan : That is, for a total value of COP$1,500,000 VAT included, you will be able to claim a total of nine (9) pairs of glasses from any of the references listed on the Sajú Website (now or in the future), the which must be claimed within the next three (3) years from the Inauguration Date. You will receive three (3) pairs of glasses of your choice, for each year, in accordance with the other conditions set forth in this document.
  • Information Treatment Policy : It is the policy that defines the way in which the Personal Information of each of the Participants will be handled and treated. This is duly published on the Sajú website available at https://www.saju.co/pages/politica-de-privacidad
  • Organizer or Sajú : Refers to La Familia del Mono SAS
  • Territory: Memberships can be purchased through the Sajú Website or at the Sajú Calle 81 Store. Without prejudice to the above, to claim the glasses that are the subject of the Plans you must go to the Sajú Calle 81 Store.
  • Tienda del Mono Calle 81 : Refers to the Sajú store located at Carrera 9 #81-25 in the city of Bogotá.
  • Member(s) Holder(s) : Refers to the person who acquired one or more of the Membership plans.

3. General Description of the Dynamics

  • On March 1, 2024, within the framework of the inauguration of the optician in the Tienda del Mono Calle 81, the first one hundred (100) people who acquire one or more of the Memberships will acquire the benefits indicated in section 5 of these Terms and Conditions.
  • The Dynamic will be in effect on the Opening Day in the Territory or until supplies last, that is, the one hundred (100) Memberships available, whichever comes first.
  • In total, there are one hundred (100) Memberships available. A certain number of Memberships is not discriminated by type of plan (Bronze Plan, Silver Plan and Gold Plan).
  • One (1) person may purchase the number of Memberships they wish in an unlimited manner.
  • Each Membership includes an optical examination for each pair of glasses that will be delivered in accordance with the purchased plan.
  • The value of each pair of glasses to be delivered cannot exceed the price of COP$500,000. If this amount is exceeded, the Membership Beneficiary must pay the excess value.
  • The promotion provided for in these Terms and Conditions expressly excludes glasses that are limited edition or come from collaborations between Sajú and specialized third parties.
4. Characteristics of the Participants
  • Participation in the Dynamic is open to any interested consumer, natural person, aged 18 years or older, resident and domiciled in Colombian territory and who meets the conditions of participation established in this document.
  • Employees, collaborators and other third parties who have a direct or indirect relationship with the Organizer are excluded from participating in this Dynamic.
5. Characteristics and Conditions of Memberships
  • What do Memberships consist of?
 
The first one hundred (100) people to acquire Memberships may obtain one or more of the following plans:
 
Bronze Plan : That is, for a total value of COP$500,000 VAT included, you will be able to claim a total of three (3) pairs of glasses from any of the references listed on the Sajú Website (now or in the future), which must be claimed within the next three (3) years from the Inauguration Date. You will receive one (1) pair of glasses of your choice, for each year, in accordance with the other conditions set forth in this document.
 
Silver Plan : That is, for a total value of COP$1,000,000 VAT included, you will be able to claim a total of six (6) pairs of glasses from any of the references listed on the Sajú Website (now or in the future), the which must be claimed within the next three (3) years from the Inauguration Date. You will receive two (2) pairs of glasses of your choice, for each year, in accordance with the other conditions set forth in this document.
 
Gold Plan : That is, for a total value of COP$1,500,000 VAT included, you will be able to claim a total of nine (9) pairs of glasses from any of the references listed on the Sajú Website (now or in the future), the which must be claimed within the next three (3) years from the Inauguration Date. You will receive three (3) pairs of glasses of your choice, for each year, in accordance with the other conditions set forth in this document.
 
One (1) person can purchase more than one (1) Plan. There is no limit on plans per person.
 
Membership Holders must make one (1) single payment according to the selected Plan.
 
  • How is Membership acquired?
 
The purchase of any of the Memberships can be made through the Sajú Website or directly at the Tienda del Mono Calle 81 on Inauguration Day.
 
  • Including?
 
For each pair of glasses delivered in any of the aforementioned plans, one (1) optical examination is included that will be performed at the Tienda del Mono Calle 81.
 
Included in the Dynamics are any pair of glasses available on the Sajú Website at the choice of the Membership Beneficiary, at the time of claiming each pair of glasses. That is, sunglasses, formulated, screen or formulated sunglasses can be claimed in any of the frames, subject to availability.
 
It is not possible to claim more than 1, 2 or 3 glasses, according to the plan purchased, in a single year. It is also not appropriate to request glasses for subsequent years in advance.
 
It is not possible to request a separate optical examination for each of the glasses delivered in accordance with the Membership purchased. That is, the optical examination will be included with the delivery of each of the glasses, whenever requested by the Membership Beneficiary. This implies that you cannot claim the optical examination separately from the pair of glasses being claimed or request a refund of the value of the optical examination in cash.
 
The glasses selected by making the Membership effective may not individually exceed the value of COP$500,000 VAT included. If this value is exceeded, the Membership Holder or Beneficiary must assume the excess amount.
 
The prices of the glasses may vary during the period in which the Membership can be effective, that is, until March 1, 2027.
 
Under no circumstances will the Membership acquired be redeemable partially or in its entirety for cash, voucher for the acquisition of another product and/or other similar purpose.
 
  • Who can receive the glasses that are the subject of the Dynamics?
 
The pairs of glasses provided under each of the plans may be for people other than the person who purchased the Membership. Without prejudice to the foregoing, in the event that one or more of the glasses are delivered to one or more Beneficiaries of the Membership, the Membership Holder must attend together with the first to the Tienda del Mono Calle 81 to make the benefit effective. presenting your citizenship card or identity document.
 
  • When?

 
Depending on the Membership acquired and as explained in section 5.1, a limit on the number of glasses may be claimed annually.
 
Those who acquired Membership will have from March 1, 2024 to March 1, 2027 to make the purchased plan(s) effective.
 
The formulated glasses will be delivered within 7 to 10 business days from the day the exam was carried out at the Tienda del Mono Calle 81 optician.
 

6. Personal Data

  • The Organizer of the Dynamics will request the Membership Holders' prior and express acceptance for the processing of their personal data. The Organizer undertakes that the personal data collected from the Membership Holders on the Opening Day will be used solely and exclusively for the purposes described in this document for the development of the Dynamic. The Organizer will not be responsible for the eventual dissemination of the personal data of the Membership Holders carried out by persons other than the Organizer, nor will it be responsible for any possible damages and losses that such circumstance generates to each Membership Holders. Additionally, the Organizer declares that the data processing carried out under the Dynamics will be carried out in accordance with Decree 1074 of 2015 and other applicable regulations, as well as as stipulated in the Information Processing Policy, in where the owners of personal data can find the means to exercise their rights related to their processing.
 
  • The Holders and/or Beneficiaries of the Membership authorize the Organizer to use their email and personal data to receive information on promotions and any other data that the Organizer has in accordance with its Privacy Notice, without this granting the right to charge any amount. of money or things.
7. Responsibility of the Organizer
  • The Organizer will not assume any responsibility, during and/or after the Opening Day, for any technical problem or malfunction that is independent of the action and/or intervention of the Organizer.
 
  • The Organizer will not be responsible for damages or losses that the Participants may suffer in their person and/or property due to and/or on the occasion of the Dynamic, which have not been caused by the Organizer, declining all types of contractual and extra-contractual liability. that the Participants may consider to be their responsibility.
 
  • Likewise, the Organizer will not be responsible for non-delivery of the Membership to the Participants, when the stock of units has been exhausted, since the condition regarding the availability of units has been duly informed.
 
  • To the extent permitted by Law, Sajú reserves the right to suspend or cancel the Dynamics in whole or in part due to an unforeseen event or force majeure, or if it is proven that any type of fraud has been committed, such as alterations, imitations, substitutions or any other irregularity detected by the Organizer. If for any of these reasons, the Organizer is forced to cancel, suspend or postpone the Event, it will notify the participants by any means it deems necessary. Sajú will not assume any responsibility for total or partial non-compliance that occurs due to the indicated causes.
 
  • The Organizer reserves the right to modify any of the points stated in these Terms and Conditions without assuming responsibility in this regard, provided that the Law allows it. Participation in the Dynamic implies acceptance of the decisions made by the Organizer on each and every aspect of the Dynamic.
 
  • The Organizer will not be responsible for any damages that participants or third parties may suffer as a result of the Dynamics. At no time will the Organizer be responsible for direct or indirect damages suffered by any participant before, during and after the Event.
8. Special Provisions
  • The names and image of the participants may be published by the Organizer for the purposes of promotion, dissemination and advertising of the Organizer's brands and/or products anywhere in the world for an unlimited period.
 
  • By reading and accepting this document, participants authorize Sajú to use, reproduce in all its forms, transform, adopt, communicate, publish, market and, in general, carry out any type of exploitation of the photographs or works in which it appears. your image or vox, through existing and future traditional, alternative, digital and/or analogue media.
9. Applicable Law
These Terms and Conditions will be governed and interpreted in accordance with the Laws of the Republic of Colombia.
